By accessing or using Xspare ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Platform.
2. About Xspare
Xspare is an online marketplace that connects customers looking for used or refurbished automobile spare parts with verified salvage yards and spare-parts vendors in Kerala. Xspare acts solely as an intermediary and is not itself a buyer or seller of spare parts.
3. User Accounts
Customers may submit part enquiries without creating an account. Phone-number verification is required to receive quotes.
Vendors must register and be approved by Xspare before they can respond to enquiries.
You are responsible for maintaining the confidentiality of your login credentials and all activity that occurs under your account.
You must be at least 18 years old to use the Platform.
4. Enquiries and Quotes
Submitting an enquiry is free of charge for customers.
Quotes provided by vendors are indicative only. Prices, availability, and condition of parts are subject to change until a transaction is confirmed directly between the customer and the vendor.
Xspare does not guarantee the accuracy, completeness, or reliability of any quote or vendor listing.
5. Transactions
All transactions for spare parts are conducted directly between customers and vendors. Xspare is not a party to any such transaction and accepts no liability for:
The quality, safety, or fitness for purpose of any part supplied.
Delays, non-delivery, or disputes arising from vendor–customer transactions.
Any loss or damage arising from the use of parts purchased through the Platform.
6. Payments
Where a customer accepts a quote and pays through the Platform, the payment is processed online by our payment partner, Razorpay, using the methods it offers at checkout (such as UPI, cards and net banking).
The total payable (part price plus any courier charge) is shown on the confirmation screen before you pay. Prices are in Indian Rupees.
Xspare does not see or store your card, UPI or bank credentials; these are handled by Razorpay under its own terms and privacy policy.
You will receive a payment reference ID on success. If money is debited but your order is not confirmed, write to us at [email protected] with that reference and we will investigate; amounts not applied to an order are refunded to the original payment method.
Cancellations, returns and refunds are governed by the Shipping & Returns Policy and Section 15 below.
7. Used Parts & Disclaimers
Every part listed through the Platform is a used or refurbished part, not a new one. Normal wear is expected, particularly on Grade B and Grade C parts.
The grade (A, B or C), condition, photos and description of a part are provided by the vendor. They are a good-faith description, not a guarantee, and Xspare does not independently inspect parts before sale.
You are responsible for confirming that a part fits your vehicle (make, model, year, variant and, where relevant, your VIN or old part number) before you pay. A part that does not match the vehicle given in your enquiry is eligible for return under our Returns Policy.
Parts do not carry a manufacturer's warranty. Any warranty offered by a vendor is the vendor's own and applies only if it is stated in writing in the quote or order.
Safety-critical parts (for example airbags, brakes, steering and suspension components) should be inspected and fitted by a qualified mechanic. Xspare is not responsible for loss or injury arising from incorrect installation or from use of a part beyond its condition.
8. Vendor Obligations
Vendors agree to:
Provide accurate descriptions of parts including condition, make, model compatibility, and price.
Respond to enquiries in a timely and professional manner.
Not engage in fraudulent, misleading, or deceptive conduct.
Comply with all applicable laws relating to the sale of used auto parts in India.
Xspare reserves the right to suspend or permanently remove any vendor found in violation of these obligations.
9. Prohibited Conduct
You must not:
Submit false, misleading, or spam enquiries.
Use the Platform for any unlawful purpose.
Attempt to scrape, reverse-engineer, or interfere with the Platform.
Harass, abuse, or harm other users or vendors.
10. Intellectual Property
All content on the Platform, including the Xspare name, logo, and website design, is the intellectual property of Xspare. You may not reproduce or distribute any content without prior written permission.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy. By using Xspare, you consent to the collection and use of your information as described therein. We collect your phone number and enquiry details solely to facilitate connections with vendors and to improve the Platform.
12. Limitation of Liability
To the maximum extent permitted by law, Xspare and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.
13. Indemnification
You agree to indemnify and hold harmless Xspare and its operators from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform or breach of these Terms.
14. Modifications
Xspare reserves the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
15. Returns & Cancellations
As Xspare is a marketplace and not the seller of parts, returns and cancellations are governed by the following:
Customers may raise a return request for wrong or damaged parts within 7 days of receiving the order by contacting the vendor directly or writing to us at [email protected].
Vendors are obligated to accept returns for incorrect or damaged parts within this window. Refund timelines depend on the payment method used.
Xspare will assist in mediation where a customer and vendor are unable to resolve a dispute independently.
Xspare does not guarantee refunds for transactions conducted entirely outside the platform.
16. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kerala, India.
